More than half the newly elected Maharashtra MLAs or 165 of 288, declared pending criminal cases in their affidavits, according to an analysis of election affidavits by the Association of Democratic Reforms.

These include:

74 of 122 Bharatiya Janata Party (BJP) MLAs: 61%

48 of 63 Shiv Sena MLAs: 76%

15 of 42 Congress MLAs : 36%

19 of the 41 NCP MLAs: 46%

Overall, 86 (33%) have declared that charges against them have been framed in these cases.

SERIOUS CASES

The ADR’s analysis of information filed by the newly elected MLAs goes separately into serious cases. These include murder, attempted murder, kidnapping and crimes against women.

40% MLAs across political parties have declared such cases. This is higher than the 2009 count of of 33 per cent MLAs with serious criminal cases. Facing such charges are:

46 BJP MLAs: 38%

35 Sena MLAs: 56%

10 Congress: 24%

18 NCP MLAs: 44%

MURDER: 3 MLAs: 2 BJP, 1 Shiv Sena

Attempted murder: 15 MLAs (5 BJP, 2 NCP , 7 Sena, 1 independent

CRIME AGAINST WOMEN: 11 MLAs (5 BJP, 6 Shiv Sena). 8 MLAs have declared cases relating to assault or using criminal force against a woman with intention to outrage her modesty.

OTHER CASES

3 MLAs have declared cases relating to disruption of communal harmony. These cases include promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc., and performing acts prejudicial to maintenance of harmony (IPC Section-153A) and injuring or defiling place of worship with intent to insult the religion of any class (IPC Section-295)
